Just like anything, legal or not, people will still get it. Take guns off the market, people will get them off of the black market. It's that kind of situation.
 
Second-hand smoke kills. How is that "respecting" others' rights?

If I made you breathe smoke or put a cigarette up to your face, that would be violating your rights. You can smoke without making someone else breathe in the smoke. Just like you can drive a car without running over pedestrians.

This hasn't really been a debate thread, it seems to me it's mostly been a, "I totally agreee with that too", thread.

Purposes of making a debate thread:
-Flame war
-Raging
-You want peoples' opinions

How debate threads fail:
-If they don't get any posts
-If people are staying calm
-The topic is not as controversial as my Abortion thread which spawned lots of long posts, flame wars, raging, and 30+ pages

I went the right direction with the Abortion thread.

Perhaps because it can be highly destructive to the individual and those around them.

So is consuming too much sodium, but that's not illegal.

No. If I was going to start a business, I would not allow smoking inside. This would please many customers. However, customers who want to smoke inside would not be pleased. So they would go down the street and go to the business that allows smoking. Everyone is happy because there is freedom of choice. Of course if no one wants to smoke inside, then both businesses would be smoke-free because that's what the market demands.

The employees have a right to not enter a place that they don't like (a place with smoking). I don't like how some businesses operate for other reasons, but it's their right. Certainly if most employees aren't smokers, it would be a wise business decision to not allow smoking. If an employer thinks he is pleasing his employees by allowing smoking inside, then I will seek employment else where. Just like if you want good food from a restaurant, you go to a restaurant you like. It doesn't mean we make it illegal to open a restaurant with food you don't like. I don't like sushi. I don't even like the smell of sushi. But I don't think it should be illegal for people to eat sushi or for businesses to sell sushi.

difference being that smoking is not centrally effecting the smoker, but also those who are in the immediate area, via second-hand transfer.

@ you can smoke without making someone else breathe in smoke, do you feel like, maybe, just by random chance, giving an example to back up your statement? sure, if you have the space to distance yourself away from others, but in many cases, that luxury is unavailable.
