My problem/s with Proposistion 8

As all should know, Proposition 8 passed in California in November after 5 or so months of legal same-sex marriage. There are many many things that irk me about the proposition but seeing how....restricted we are here I'm only to say a few.

The one which I will mention is how marriage is even in the legal system. I know, at this point it has been grandfathered in enough that it should stay but if we're arguing over a term that does have religious meaning why are we arguing over it with law? If Church and State separation is to be true marriage should be done away with. However, as I said before, this will not happen. Thus, with America following at least one other part of the 1st Amendment, the American government can not favor a religion over another. One can try to argue that the meaning of marriage is universal but with the current debate that is doubtful...especially when definitions, separate from ancient religious texts, can change over time. When the government adopts this meaning of marriage they are adopting the culture along with it....as language had done since the beginning of phonograms (Some languages don't have a word for God, you know ;)).

I have friends who are crazy about gay rights and friends who think being gay (despite this being false according to their bible) is a sin. Still, they all agree that under the American Constitution it should be allowed as "civil unions" and "marriage" are in no way equal. (Brown vs. Board of Education). Separation of Church and State is not just for the State to be protected from the Church but also so that the Church is to be protected from the State. Religious institutions have to respect and follow the former in order for the later to still be valid.

And, on a side note, I think the main reason why so many Blacks voted for Proposition 8 to be passed is not because of Obama (don't think that one race is so gullible like that... (This refers to Blacks voting yes down the line assuming everything is Democratic or Obama)) but because many gays, or at least a loud some, are comparing what they're going through with the civil rights movement. While there are severe mistreatments, you can hide your sexuality....you can't hide your race. If this comparison is stopped I believe same-sex marriage would be re-allowed.

One topic, which I did leave out, is how the majority is voting on the rights of a minority. Our founding fathers and our constitution are turning over in their graves.

And if by chance this is not allowed just lock it as I put time into this.

I live in Canada where it's been legal for a while now and personally, Prop 8 disgusts me.
 
Government should not define marriage either way. It should be left to private institutions and the couple. This would make both sides of the argument happy. Glad I'm not the only one who says this. I don't know why you say "it won't happen" though... that's how it used to be.

I also agree that private institutions should not be forced to marry anyone....as I hear this is an issue as well.

Regarding your edit: For the same reason we have "under God" in the pledge, feet instead of meters, and the penny...too much trouble to change.

They've been doing that for decades... the 10th Amendment isn't even taught in schools ._.

Proposition Eight was a terrible loss for civil rights and common sense. It is an issue that should not even be up for vote...all people deserve the same rights, and this is blatant discrimination against homosexuals with no reasoning other than the ridiculous and childish prejudices that continue to plague our society. Voting should be to decide how to run the government; none of us has any right to decide how other people live their lives.

This is also completely unconstitutional, which of course doesn't matter to these imbeciles because they've never read the constitution. The fact that it was allowed to pass is abhorrent. It violates the freedom of religion by taking an official government stance on a religious issue; marraige. It is basically the government stating that any religion which believes gay marraige is okay is not allowed to exist, thereby throwing the entire concept of liberty out the window. Proposition Eight has taken us one step closer to theocracy and another step away from freedom.

Almost everything the federal government does today is unconstitutional... so it doesn't mean much to people.
