Tenth villager moved in by herself?

how is that possible? as far as i knew, the tenth space was reserved for asking villagers from other towns to move in. i had 9 and then randomly someone moved in?

Yeah, it happens via Streetpass. I found this out myself when Timbra decided to move in, uninvited and unwanted from my nephew's town.
