It seems like 9/10 times I get a streetpass the person has games but NOT streetpass mii plaza like I got 20 people this week and only 4 had the mii plaza, is there an issue with my 3ds or am I just unlucky? I know my mii plaza works because I streetpass my second system and it works fine.

I'm pretty sure that it pretty much comes down to luck on when getting StreetPass for StreetPass Mii Plaza. Seems like either these people didn't bothered to use that app or didn't know that and dismissed it as another Mii Maker app.
Most of the games compatible with StreetPass will at some point tell you that you can activate StreetPass and let you do so right away. That's pretty much the reason why Super Mario 3D Land, Mario Kart 7, New Super Mario Bros. 2, Pok?mon X & Y and Pok?mon Omega Ruby & Alpha Sapphire are seemingly the most common games to appear in StreetPass.

Actually I think that's really common -- a lot of people never set up the Plaza, but like BigJC said games usually help you set up their streetpassing. Most of my friends, I helped them set up their plaza. I don't know why people don't do it, I'm a big fan personally!

They probably don't care enough to see what it is. When I first got my 3DS I assumed it was just another stupid Mii thing I would never use. It was only after some morbid curiosity that looked and set it up.
A lot of the time it's just really unreliable.
Both my brother and my sister have 3DS's and we live in the same house, yet I've not gotten a pass from either in about 3 days (yes, they have been on their 3DS's). It's not even an issue that they've not 'gone out of range of my DS' or anything since I've actually left the house for significant periods of time. It's just not consistent in general.
Me and my friend keep getting streetpasses from each other. I gotten them from him a few times when hanging out when he didn't even have his 3DS with him. Neither of us have gotten passes before even though we're sat next to each other playing local wireless multiplayer. We've also both had passes from each other around town even though only one of us was actually in town.
It's definitely not an 100% accurate system.
