How do getting villagers via streetpass work

If you have an open space for a villager to move in and you streepass someone with villagers in their void then it's possible for them to move into your town

It has happened to me a few times, picking up SP'ed voided villagers. I actually went into my DS and turned off the option to SP on AC.
