Is spotpass like a hot spot where people connect with there 3DS? and it only works if its a wifi hot spot? because if this is the case I will never obtain this tree, i'm the only one in this tiny town that has a 3DS, and even in the large towns I only ever streetpass with one guy, the same guy always, like wth....

No, Spotpass can be obtained if you are connected to wifi on your 3DS, and of course it must be turned on.
