If it does that frequently, definitely contact Nintendo and ask them about it, check your warranty info, et cetera et cetera. If this is just because you play too long without charging the battery, then there's nothing anyone can do to help you lol.
Losing data does suck though, I feel you on that. If it's the latter issue you can always try to remember to plug your 3DS in overnight when you sleep, and/or play on the lowest brightness setting with the 3D off (which is what I do). If you have a laptop you can also fire that up and play next to it wired, so. There's that.
