You can perform a system transfer under system settings, so you wouldn't lose anything.

Funny thing is when i gave Gamestop my old 3Ds they formatted the system's memory right after i got my new XL so its impossible now to do so lol

Aww, that sucks. The games were pretty awesome IMO. You paid 249 dollars (and 169 more!) so you deserve some kinda prize.

Well i did take in consideration of the possible consequences of purchasing another 3ds, but i still think that Gamestop should of alowed me the time to transfer my data, but whatever i never really played any of those games so no big deal

If you bought the 3ds when it first came out for 250$, then you would gotten 20 free arcade games since after dropping the price nintendo felt that they should reward they're customers by giving them free 3ds shop games

Nintendo gave whoever bought the 3DS before the price cut 10 free NES games and 10 free GBA games. I mean, it was $250 and now it's $170. That's $80 everyone could have saved, and Nintendo being the nice guys that they are, gave the die hard fans who got it on launch something a little worth their while.

I didn't get the XL though and don't regret it. I really like the look of the 3DS compared to the XL despite it being a fingerprint magnet.

That's different. Pokemon giveaways are local, IE no internet. But Gamestop should have allowed him to leave and come back with the old one. Try contacting Nintendo and explain your situation, perhaps you'll come across an understanding rep.
