and its probably from overusing the shoulder buttons

This happens to pretty much everyone lol. It seems like every kind of 3DS has its problems.
3DS L and R buttons wear out quickly
3DS XL has super fragile hinges (specifically the right hinge and idk why)
New 3DS and the XL version don't have any probems so far (or that I'm aware of) but they are supposedly super hard to record footage from and hack.

I have a New 3DS XL and the shoulder buttons aren't any harder to press down than a regular XL. Yours sounds like a faulty unit.

The only problems I know of with the N3DS systems are the N3DS-enhanced games messing up and recognizing the unit as a regular 3DS instead. It's a software issue though, and pretty rare.

Oh yeah I've heard about that happening to a few people with Legends.
