Tomatoes, are in fact the fruit of the plant, buuut nutritionally act as a vegetable as classified on the food pyramid. Sooo really its both.

They are Fruit because they have seeds. End of.

here we go wiki has the answers and the clear answer is that it is a fruit but is used more like a vegetable, and lets just blame the US supreme court for mucking it up.
