Are new 3DS systems already updated to the latest version?

Say, you buy a 3DS, -- because the the fact you can't do things people with a version below 9.5.0-23 can kinda sucks -- would the newly bought system already be updated to the latest version?

If not, in which cause it would ask you to be updated, would that be forced? Or can you skip it?
 
My friend just got one the other day and was given the "update" prompt once he powered it on. I don't think it was required, but I don't know at what version it started on.

Yes if it's brand new it will require. When I bought my MM New 3ds XL I had to do pretty much everything there is. If it's used however you might or might not depending on how old/used it is.
 
I do know that when you buy a 3DS (XL), the device immediately tries to update if it can connect to the internet. And I do believe that the devices are updated to the latest version at time of manufacturing, so unless your local game store has been holding some older units for some time (ie: they weren't selling for whatever reason), you should have near to the most updated version.
 
For the purposes of '9.5.0.23 and lower' the N3DS can't do it because the browser option on it is completely different from the start, doesn't even matter what system update it's on.
In general though, you don't have to update when you first power on if you just prevent it from going online, and the system version is different depending on the date the console was manufactured. I don't think it's very consistant.
