Just popping in to answer this question; you bet your sweet ass you might. I've gotten three so far; two from a friend, and one from literally nowhere. I've been travelling so much that I picked one up from the void. Needless to say, it's pretty infuriating :')
*Note: by travelling I mean to others' towns/having people visit me, I have like zero streetpass locations near me, so yeah. I've been picking voided villagers up like nobody's business.

I honestly don't know the mechanics at all; the random one I got was Felicity, but I've been trying to ignore her to see if she'll leave. (I like her, but she's not a dreamie.) I forgot where she said she'd come from, but it wasn't my friend's town -- it was absolutely one of the 50+ people I've visited from this forum. I don't know when they voided her or anything -- my friend's voided characters came to me like... Idk... A WEEK after she voided them or something?? It was so ridiculous. Again, this isn't streetpass, this is from people I've just been trading with and whatnot. I couldn't tell you if someone WILL fill it or won't, but there's totally a chance; I just don't know how much of a chance. ): I'm really sorry, I know how it feels -- it feels awful, especially considering I was saving that spot there for Chrissy...

oh my gosh, i've been trying SO HARD to get drake to move and finally he asked and someone adopted him, someones holding marshal for me and i've been trying to get a free slot for them but thing is they ahvent got amrshal to ping yet and im not sure how long it will take until he pings /marshal pls dont be stubborn/

Yeah, I would be REALLY careful... Nintendo just-- god. I don't even wanna get into it. I don't know why Nintendo thought that grabbing random villagers from the depths of hell to give to people spontaneously to FILL UP THEIR TENTH SLOT was a good idea. Just be careful. ;_; I wish you the best of luck -- I hope you don't suffer the same fate as me. I'll cross my fingers for you. I hope you get Marshal before anyone's voided decide it's a good idea to come to you.
