Who owns Burnout 3?

I just bought it this evening for about ten bucks and I have two bad problems with it.

Whenever you hit the gas, the speed fluctuates. Sometimes, it will drive at around 5 miles an hour for a few seconds, or it will instantly hit to about 50, then it will often stay at 50 and 60 while everyone else is leaving me behind. I find it helpful to keep tapping the X button(gas) to make it go faster...like that is supposed to change gears? But why so akward? And the left analog stick sorta does the job, but not as well as the X button.

I probably know what you're thinking...you gotta use the boost. But once everyone leaves you behind, it's virtually impossible to build up enough boost to even reach the guy in last place before the race is over. Once you hit someone and get boost, it's a much better game, but why make it this way? Almost every single race starts out like this. It's like once everyone leaves you behind, the game's saying "sorry, time to start over".

And problem number two: why are the controls unresponsive? When I am just in the menu screens, I often have to keep mashing the X button to select, then other times, I can hit it once and it will select. The analog and d-pad works the same way...it will often not do what I want it to do. This gives me such a headache.

Burnout 2 was definitely not like this. I never got to play the first, but I'm betting it wasn't like this either, so what's wrong?
 
The driving in GTA IS better to me. Actually, any game that allows you to control car with a working gas button is effectively better than this game.

I love driving normally in GTA .. :] and racing games are ownage
